WHY THIS NOTICE

This page describes how the site is managed in relation to the processing of personal data of users who consult it.
This information is also provided pursuant to Article 13 of European Regulation EU 2016/679 (GDPR) to those who interact with the Data Controller’s web services, accessible electronically from the address: https://www.boscoviticultori.com.
Please note that this information is provided only for the aforementioned site and not for other websites that may be consulted by the user via links.
This information notice also takes inspiration from Recommendation No. 2/2001 adopted on 17 May 2001 by the European data protection authorities gathered in the Group established under Article 29 of Directive No. 95/46/EC, which identified certain minimum requirements for the collection of personal data online, in particular, the methods, timing, and nature of the information that data controllers must provide to users when they connect to web pages, regardless of the purpose of the connection.

PLACE OF DATA PROCESSING


The processing connected to the web services of this site takes place at the Controller’s headquarters and is handled only by personnel authorised to process data, or by those charged with occasional maintenance operations.
No data deriving from the web service is communicated or disseminated.
The personal data provided by users who submit requests (to receive information, to be contacted, etc.) are used solely for the purpose of performing the service or request made, unless otherwise specified in specific information notices concerning data processing that may appear when data is entered or collected.
Unless otherwise stated in the specific notice related to the requested service, data are communicated to third parties only when necessary to carry out the service or request.
In addition to the Controller, in some cases, categories of persons involved in the organisation of the site (such as external technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data and, if necessary, be appointed as Data Processors by the Controller.
An updated list of Data Processors can always be requested from the Controller.

TYPES OF DATA PROCESSED


Browsing data

The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified.
This category of data includes IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response from the server (successful, error, etc.), and other parameters relating to the user’s operating system and IT environment.
These data are used solely to obtain anonymous statistical information about the use of the site and to check its correct functioning, and are deleted immediately after processing.
The data could be used to ascertain responsibility in the event of hypothetical computer crimes against the site; except for this eventuality, data on web contacts are not retained for more than seven days.

Data voluntarily provided by the user

The optional, explicit and voluntary sending of e-mails to the addresses indicated on this site or the filling in of specific data entry forms to request information or make requests entails the subsequent acquisition of the sender’s address, necessary to respond to the requests, as well as any other personal data included in the message.
Specific summary information and, where necessary, consent requests will be progressively reported or displayed on the site pages set up for particular on-demand services.

PURPOSES OF PROCESSING

The data provided by the User will be processed, without the User’s prior consent pursuant to Art. 6(b) GDPR, for the following Service purposes:
a. to manage and process statistical surveys on the use of the Site;
b. to perform maintenance and technical assistance necessary to ensure the proper functioning of the Site and related services;
c. to improve the quality and structure of the Site, as well as to create new services, features and/or characteristics thereof;
d. to provide prompt and complete responses to requests submitted through the site www.vinimontresor.com;
e. to allow the Company to exercise its rights in judicial proceedings and to prevent unlawful conduct;
f. to comply with legal or regulatory obligations.

The data provided by the User will be processed, with the User’s prior consent pursuant to Art. 6(a) GDPR, for the following purposes:
g. to send newsletters and commercial information, exclusive and personalised promotions, invitations to events and trade fairs.

LEGAL BASIS OF PROCESSING


The processing of data by Casa Vinicola Bosco Malera srl is based on the consent given by the user.
Providing personal data via the specific form on the website https://www.boscoviticultori.com is not mandatory; however, refusal to provide such data makes it impossible to fulfil the user’s request.
Conversely, for marketing purposes, the user’s specific consent is required; the absence of such consent will not, however, affect the provision of the requested service.

METHODS OF PROCESSING


The processing of Users’ data is carried out by means of the operations indicated in Art. 4(2) GDPR and, in particular: collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, access, use, interconnection, blocking, communication, erasure, and destruction of data.
Users’ data are processed both by automated and non-automated means, in such a way as to ensure their security and confidentiality, for only as long as strictly necessary to achieve the purposes for which they were collected and, in any case, no longer than 10 years from their collection for the Service purposes referred to in point 1, and no longer than 2 years from their collection for the Commercial purposes referred to in point 2.

SCOPE OF DISCLOSURE AND DISSEMINATION


Without the User’s express consent (Art. 6(b) and (c) GDPR), Casa Vinicola Bosco Malera srl may disclose User data for Service purposes to supervisory bodies, judicial authorities, as well as to all other entities to whom disclosure is mandatory by law for the fulfilment of the said purposes, as independent data controllers.
Users’ data will not be disseminated.
Personal data may become known to those authorised to process data.
Personal data will not be communicated to other parties, nor will they be disseminated, except to support structures connected with the Company, as well as to professional firms or companies involved in carrying out the Company’s activities and in fulfilling related legal and fiscal obligations.

PHOTOGRAPHS AND IMAGE RIGHTS


By participating in events organised by Casa Vinicola Bosco Malera srl, the user expressly authorises Casa Vinicola Bosco Malera srl to capture the user’s image(s) by television, film, photographic or other means during their presence at the event, and confirms this authorisation by recognising Casa Vinicola Bosco Malera srl’s right to record, reproduce, print, publish, project, distribute, and otherwise use them by any means currently known or that may be invented in the future, without time or territorial limits, worldwide.
The user also authorises the transfer to Casa Vinicola Bosco Malera srl’s commercial and institutional partners of the rights to use such images, including for promotional and/or advertising purposes.
The user further declares that they have nothing to claim from Casa Vinicola Bosco Malera srl and/or its assignees, successors, or anyone who uses and exploits their image, as any such claim is satisfied by the opportunity to take part in the event.

OPTIONAL NATURE OF PROVIDING DATA


Apart from what has been specified for browsing data, the user is free to provide the personal data indicated in the request forms or otherwise provided in contacts with the Controller.
Failure to provide such data may make it impossible to obtain what has been requested.

DATA SUBJECTS’ RIGHTS


The GDPR grants you a series of rights (Articles 15 to 21) for the protection of your personal data:
You will always have the right to access information concerning you and to be informed of the methods and purposes of the processing to which such information is subject;
You have the right to rectification, i.e., to amend data if it is inaccurate or not up to date;
You have the right to request erasure, to object to processing or to an automated decision-making process, or to obtain restriction of processing, where provided for by law;
You have the right to obtain the portability of the personal data you have provided, if processed by automated means on the basis of consent or for the performance of a contract.
Furthermore, if your processing is based on consent, you will always have the right to withdraw it. Please note that (i) this does not affect the lawfulness of processing based on consent before its withdrawal, and (ii) such withdrawal may prevent the Company from pursuing the purposes you have requested.

JURISDICTION


For any dispute that may arise between users and the Data Controller or other parties who have collaborated, collaborate, or will collaborate with Casa Vinicola Bosco Malera srl, users accept the jurisdiction of the Italian State and, in any case, the application of Italian law regardless of their domicile or place of business.
The competent court is that of TREVISO.
